Terms of service

These terms are the agreement between you and MyMarkt when you use the app. By creating an account you accept them, along with our privacy policy. If you don't agree, please don't use MyMarkt at mymarkt.ca.
1. Who can use MyMarkt
You must be at least 18 and able to enter a binding contract. One account per person. Keep your login details to yourself — you're responsible for what happens under your account. Phone verification is required before you can post a listing, create a hunt, or send messages; browsing is open without it.
2. We are a venue, not a party to your deal
Users transact directly with each other. MyMarkt is the venue where you find each other and nothing more. We are not a buyer, a seller, an agent, a broker, an auctioneer, an escrow service, a shipper, or a party to any contract you form with another user.
- We do not take possession of, inspect, test, authenticate, photograph, insure or deliver any item.
- We do not handle payment. You and the other user agree how and when money changes hands, entirely at your own risk.
- Any contract of sale is between the two of you. Disputes, refunds, returns and warranties are between you as well.
- Listing content, prices, condition claims and photos are the seller's responsibility. AI match scores and explanations are estimates to help you look, not a verification of anything and not advice.
- Ratings and completed-deal counts are user-generated. We don't vouch for any user's honesty or for any item's authenticity, legality, safety or fitness for purpose.
3. Meeting and staying safe
Exact meeting details are shared between users in chat — we never publish an address or precise location. Meet in public where you can, bring someone, inspect before you pay, and trust your instincts. You are responsible for your own safety when you meet someone. Never share passwords, banking credentials or one-time codes with another user.
4. Services arranged through MyMarkt
Service arrangements are strictly between users. We do not vet, background check, licence check, certify, supervise, bond or insure any service provider, and we do not guarantee the quality, safety or legality of any work. Verify qualifications, licences, insurance and references yourself before hiring anyone, and before agreeing to do work for anyone. For regulated or safety-critical work — gas, electrical, structural, medical, legal, financial or childcare — confirm the provider holds the licences and insurance your province requires. Any price, schedule, scope or payment terms are agreed directly between you and the other user, and any dispute about the work is between you as well.
5. Prohibited items and conduct
You may not list, ask for, offer, or arrange to trade any of the following:
- Weapons — firearms, firearm parts, magazines, ammunition, replicas, prohibited knives, explosives, and any weapon restricted or prohibited under Canadian law.
- Drugs and controlled substances — illegal drugs, prescription medication, drug paraphernalia, vapes and nicotine products, and cannabis outside a licensed channel.
- Counterfeits — replicas, knock-offs, fakes, or anything infringing someone else's trademark or copyright, including pirated media and software.
- Stolen goods — anything you don't own or aren't authorized to sell, and items with removed or altered serial numbers.
- Recalled products — anything subject to a manufacturer or Health Canada recall, or that fails Canadian safety standards.
- Live animals, human remains or bodily fluids, and hazardous materials.
- Alcohol and tobacco, government documents and identification, personal data lists, and financial instruments or accounts.
- Adult services, anything sexually exploitative, and anything else illegal where either of you is located.
You also may not:
- Harass, threaten, defraud, impersonate or discriminate against anyone.
- Post spam, referral bait, off-platform advertising or misleading listings, or create duplicate or automated accounts.
- Scrape, crawl or bulk-extract other users' content, or use the AI features to generate deceptive listings.
- Try to break, overload or work around our security, verification, blocking or rate limits, or contact users who have blocked you.
- Use anything you see here to identify, track or turn up at another user without their agreement.
6. Your content
You keep ownership of your listings, photos, asks and messages. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, resize, display and distribute that content within the app, and to process it for matching — including through our AI provider — so the service can do its job. You confirm you have the rights to everything you upload, that your photos show the actual item, and that your listing is accurate.
7. Our right to remove listings and ban accounts
We may remove, hide or edit any listing, hunt, message or rating, and suspend or permanently ban any account, at our discretion and without prior notice — including when we believe these terms have been broken, when a report or pattern of reports suggests a risk to other users, when content is illegal or unsafe, or when we're required to act. Where it's reasonable we'll tell you why and you can reply to support@mymarkt.ca. A banned user may not open a new account. We are not obliged to monitor content, and choosing to moderate some of it doesn't make us responsible for the rest.
You can close your account yourself at any time in Settings. We may also stop offering the service or any feature of it.
8. Notifications
Using MyMarkt means we'll send you service messages — match alerts, new messages and offers, and hunt expiry reminders — in the app and by email. Verification codes are sent by SMS at your carrier's usual rates. You can turn off non-essential email in Settings; we still need to send you account and security messages.
9. Disclaimers and limits
The service is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We don't promise the app will be uninterrupted or error-free, that a hunt will find anything, or that any match, score or user is what it appears to be.
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or any loss arising from a transaction, meeting or interaction with another user. Where liability cannot be excluded, our total liability to you is limited to CAD $100. Nothing here removes rights you have under consumer protection law that cannot be waived.
You agree to indemnify us against claims arising from your listings, your conduct, or your transactions with other users.
10. Changes and governing law
We may update these terms; we'll change the date at the top and notify you in the app for significant changes. Continuing to use MyMarkt after that means you accept the update.
These terms are governed by the laws of Ontario, Canada, and the courts there have jurisdiction, without affecting any right you have to bring a claim where you live. Questions: support@mymarkt.ca.
